offers on Server following services that can be ordered by registered person (further as User). 2. Advertisement of real
estate. 3. If there is a contract (further as Contract) between User and
Withoutestateagency.co.uk, the conditions will be as per Terms and conditions.
3. User account
1. User is entitled to set up the Account using Server in order to order
Services. 2. User will register the
User account by filling up at least all mandatory information and save it. At
the same time User must agree with the Terms and conditions, processing of
personal data and declare that that he is not a real estate agent or any
intermediate within real estate agency (further as Registration). After saving
of the above, Withoutestateagency.co.uk will send confirmation of the finishing
of the registration to the email provided at registration stage. 3. Contact information
provided by User within Registration will be displayed on Server only with
agreement of User. 4. Access to User account
is secured by user name and password (further as Access data). Both User and
Withoutestateagency.co.uk must keep secrecy regarding Access data. 5. User is not allowed to
provide his/her Access data to any third person. In case that User the Access data provides, even
from carelessness, he is fully responsible for
misuse of his/her User account and Access data. Further on he/she bears all
risks of sanctions applied from Withoutestateagency.co.uk. 6. User bears in mind
that User account does not have to be accessible continuously, especially due
to neccessary maintanence of hardware and software equipment and equipment of
third parties. 7. User must not publish
any data that is in contradiction with the law of United Kingdom. User agrees
not to make Withoutestateagency.co.uk responsible for any legal claims of third
parties concluded based on publishing of data entered by User via User account. 8. If the data entered at
Registration changes, User must immediately update them in the section My Account. 9. All the information
provided by User at any time must be correct. Only the User is responsible for
consequences of false data entry. 10. Withoutestateagency.co.uk
reserves the right to refuse displaying data entered by User on Server, or to
delete such data, if any of the following points occur: a) they are in contradiction with the law of
United Kingdom; b) they are in contradiction with good manners or
threaten public order; c) it is offer or real estate agent in sense of
matter of real estate agency or if Withoutestateagency.co.uk has
reasonable suspicion that it is like that; demand of d) they are in contradiction with rightfull
interest of Withoutestateagency.co.uk.
4. Estate agent definition
1. For the purposes of these
Terms and conditions, it is understood that Estate agent (further as Agent). For earning activity
is for the purposes of those Terms and conditions understood any activity done
in order to achieve direct or indirect earnings or profit from the sale, let or
intermediate of the sale or letting of the property, further activity with
purpose of purchasement and further sell of the property.
2. Real estate agent is
not allowed within his occupation as real estate agent to make Registration of
User acount, make offer or demand, pay for the services available or Server and
send messages or advertisement through Server. This will not be applied to real
estate agent not acting as real estate agent.
3. In case that real
estate agent disobeys the restriction, the legal claim as contractual fine to Withoutestateagency.co.uk
of 3,000 GBP (three thousand pounds) arises for each disobey. The contractual
fine is payable within 15 days since the day of disobey. This provision is
without prejudice to the claim for damages of Withoutestateagency.co.uk.
4. Withoutestateagency.co.uk
reserve the right to deactivate and cancel User account of Agent, refuse his
orders, not deliver his message to other Users, all without compensation.
5. Protection of personal data
1. User agrees with
processing of his/her personal data entered within registration, which are:
name, surname, permament address, email, phone number, account number and IP
address (further as Personal data).
2. Withoutestateagency.co.uk
process Personal data in order to run the User account and for the realization
of rights and duties including payments and marketing needs. 3. Personal data will be
processed for indefined period in electronic or paper form. 4. User has right to ask
Withoutestateagency.co.uk not to process his/her personal data. This must be
done in written form to email info@withoutestateagency.co.uk.
5. User agrees that
agreement of processing Personal data is voluntary and he/she can revoke this
anytime.
6. User agrees that his
personal data are provided to parties providing Services, transportation and
payments, only to realize rights and duties from contract.
6. Messages sent via Server
1. In terms of
improvement of services and actioning against unwanted advertisement, especially
from Agents, Withoutestateagency.co.uk reserves the right not to deliver
unwanted or nagging messages sent via Server to Users.
2. User agrees that in
terms of improvement of services and actioning against unwanted advertisement,
especially from Agents, Withoutestateagency.co.uk records all messages sent
between Users and other visitors of Server through Server and those can be
archived for uncertain period of time.
7. Business corespondence
1. User agrees that
he/she can revoke sending of business corespondence connected with services,
goods or company Withoutestateagency.co.uk. This agreement can be revoked in
written form on email info@withoutestateagency.co.uk or through link
provided at the end of business communication. 2. User and those who
agreed with the cookies policy agree with saving of cookies to the memory of
his/her device. User can revoke this agreement anytime through the settings of
his web browser.
8. Final provisions
1. These terms and
conditions are an integral part of the contractual relationship between User
and Withoutestateagecy.co.uk and integral part of contracts.
2. Legal relations

the Treaties is governed by English law.

4. If there is a dispute

right for extrajudicial solution.
5. Any claims, disputes,
disagreements or contestations which may arise between the User and Withoutestateagecy.co.uk,
based on or concerning the present Contract, or in consequence of his
violation, not solvable in a way of mutual negotiations, should be passed in
consideration of Crown Court, in accordance with rules and procedures of the
named court, arbitration decisions should be final and obligatory for both
Parties.

conditions of advertisement
1. Introduction
1. Those business
conditions (further as Business conditions) regulate mutual duties and rights
arising from Contract about advertisement agreed between
Withoutestateagency.co.uk LTD, registration number 10283934 and customer.
2. Withouthoutestateagency.co.uk
is the rightful operator and administrator of internet server
withoutestateagency.co.uk available on internet address https://withoutestateagency.co.uk (further as Server).
2. Subject of contract about advertisement
1. Contract about
advertisement bonds Withoutestateagency.co.uk to provide service that User has
ordered and User bonds to pay Withoutestateagency.co.uk for such service
according to price list advertised on the Server.
2. By advertisements it
is understood an offer or demand for buy, sell and let of the property, that is
part of Order and which is supposed to be displayed on the Server.
3. Contract agreement about advertisement and activation of advertisement
1. Ordering of Package of
advertisement can be done by User in the following way:
a) Step 1. Placing the ad:
User will click on Server to Place ad, fills in details about the advertisement
and make Registration or Log into his/her account. This step ends by clicking
Continue to activation. b) Step 2. Payment for
the ad: User fills in the Order form that includes information about the
Package, information about payment method of the price of service. This step
ends by clicking Finish the order. c) Orders sent by
clicking Finish the order is suggestion for contract deal. d) Before the order is
placed, User can double check and change the details he/she provided. e) Using electronic mail
that User provided within his User account Withoutestateagency.co.uk will confirm
recieving the order without delay to User. Confirmation of recieving of the
order is not considered as confirmation about the contract and by this moment
the contract does not rise. f) After the order is
placed, User will be redirected to page where he/she can make payment for the
package. g) The contract rises by
paying for the servise/package and the ad is activated. 2. The contract for
advertising can be concluded in English. 3. The contract for
advertisement and all its parts will be kept in electronic archive of
Withoutestateagency.co.uk, where User has access to these details based on written
request for adequate amount of money. 4. Although the ad validity is not limited in time, it will stop being displayed on server after 30 days after it has been placed. User can prolong the validity for another 30 days unlimited times in section My Advertisements. This is to ensure that there are only live ads being displayed on the Server. 5. User may get email warning that his/her ad has stopped being displayed or will stop being displayed in 5 days on the Server.
4. Basic rights and obligations of both parties
1. All data entered into
the Client Server are on User?s expenses and in accordance with the
instructions available on Withoutestateagency.co.uk Server.
2. Within the options
given by Server, User can edit his/her advertisement using his/her User
account.
3. User is obliged to
publish only true information. User is further obliged to update his/her ads in
case that the status or information within is changed. 4. User take note that
information about his/her ads displayed on the server are freely distributed to
other users of internet, mainly by using of Server. User agrees that
information about his/her advertisement can be displayed in promotional
material and other commercial messages of Withoutestateagency.co.uk. 5. User must not try for
unauthorised access and manipulation of data on Server in any way. Redirect is
not allowed ? URL address of User in Ad must not lead to any commercial estate
agency servers, to servers presenting content that is not in line with good
manner or servers that contradict the legitimate interests of
Withoutestateagency.co.uk.
6. All the information
provided by User at any time must be correct. Only User is responsible for
consequences of false data entry.
7. User has right to delete
or deactivate his ad in User account section or ask for deactivation of his/her
User account or cancelling of his/her ad at any time in written form to email
address info@withoutestateagrency.co.uk.
5. Licence and related arrangements
1. User declares that he/she
posts on Server only photographs, pictures and other content (further as
Content) that are his/her intellectual property and that he/she will not use
any content without copyright.
2. In case that User is
posting Content as intelectual property, he/she gives freely the right to
Withoutestateagency.co.uk to manipulate this content for propagational purposes (further as Licence).
3. In case that
Withoutestateagemcy.co.uk will have to pay for breaking of copyright of posted
material to third person, User must reimburse all expenses for reasons provided
in this pharagraph.
6. Payment conditions
1. Server contains
information about offered services including price. Prices are including VAT
and all other fees. The price are valid as long as they are displayed on the
Server. In special cases, the price can be agreed individually.
2. User can defray for
the Services in following ways: a) by cash in residence of
Withoutestateagency.co.uk; b) by debit card via internet payment gateway. 3. Withoutestateagency.co.uk
reserves the right to refuse any way of payment from pharaghraph 6.2.
4. If User gives variable
or specific symbol within the order, User is obliged to provide those
references within the payment for the service.
5. Duty for payment for
services is fulfiled at the moment when the payment has been ascribed on
account mentioned in pharagraph 6.2. or by paying cash at the residence of
Withoutestateagency.co.uk. 6. Alternative discounts
from price of Service provided from side of Withoutestateagency.co.uk can not
be combined.
7. Currency used on the
Server is British pound (GBP).
7. Withdrawal of contract
1. If there is obligation
for Withoutestateagency.co.uk to credit User, it will be done the very same way
as User provided the payment to.
8. Return, refund and cancellation policy
1. There is no obligation for Withoutestateagency.co.uk to pay back any part of price paid for Services that started to be in use on the Server in any case.
9. Final provisions
